This website, https://www.primepropertyagency.co.uk (the "Site"), is a site owned and managed by Prime Property Agency Limited ("we," "us," or "our").  We are registered in England and Wales under company number 16080416 and have our registered office at Riverbank House, 1 Putney Bridge Approach, London, SW6 3JD. Please take the time to thoroughly review these Terms and Conditions ("Terms") before using the Site. These Terms apply to all visitors, users, and any other individuals who access or interact with the Site. By accessing or using the Site, you agree to be bound by these Terms. Our Site is made available free of charge. We do not guarantee that our Site, or any content on it, will always be available or be uninterrupted. Prime Property Agency Limited functions as a property marketing and search agency and strives to provide accurate opinions where possible. However, we cannot guarantee that the materials on our Site are always up-to-date, complete, or free from errors. We will not be liable for any losses or damages incurred by you or third parties as a result of using this Site or relying on its content.

We do not offer financial advice, and all investments made by clients are at their own risk. It is essential that you conduct your own due diligence. Any views expressed on our Site are our own and should not be interpreted as financial advice.

We welcome sharing links to the home page of our Site, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.  You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

We reserve the right to withdraw linking permission and request the removal of any links within 48 hours.

How we may use your personal information

We will only use your personal information as set out in our Privacy Policy. 

Viruses

We do not guarantee that our Site will be secure or free from bugs or viruses.  You are responsible for configuring your information technology, computer programs and platform to access our Site. You should use your own virus protection software.

By breaching these provisions, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately. 

Responsibility for loss or damage suffered by you

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any products to you, which will be set out in our Terms of Business in the event property search services are commenced. 

Governing Law

If you are a consumer, your use of this Site, these Terms, their subject matter and formation are governed by English law.  We both agree that the courts of England and Wales shall have exclusive jurisdiction, except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.

If you are a business, these Terms, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

If you are accessing our Site from outside the United Kingdom, you are responsible for ensuring compliance with any applicable local laws. We do not represent that content available on or through our Site is appropriate for use or available in other locations.

Any failure by us to enforce any provision of these Terms does not waive our rights. If any part of these Terms is deemed invalid or unenforceable by a court, the remaining provisions will remain fully enforceable. These Terms represent the entire agreement between us concerning your use of the Site, superseding any prior agreements.
